These Terms & Conditions ("Terms") form a binding agreement between you and 1776 Telecom LLC ("1776 Telecom," "we," "us," or "our") governing your use of our wireless service, devices, accessories, website, and related offerings (the "Service"). By activating a SIM, purchasing a device, enrolling in a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of legal majority in your state) to open an account. If you open an account on behalf of others on your plan, you are responsible for all activity on that account.

1776 Telecom provides wireless service nationwide. Wireless service uses radio facilities and network capacity we do not own or control, so actual coverage, signal strength, and data speeds can vary and are not guaranteed. We do not promise uninterrupted or error-free service, and we may take any action necessary to protect our network or comply with the law, including slowing, suspending, or terminating service.

Coverage maps shown on our website are provided for general reference. You should check each underlying carrier's own coverage information for the area where you will use the Service before purchasing.

Plans are offered on a prepaid, month-to-month basis with no annual contract. You may cancel your Service at any time. Your plan renews automatically each billing cycle unless you cancel before the cycle ends. Taxes, surcharges, and government fees may be added to the advertised price where applicable. Prices are subject to change; we will give reasonable notice before any change takes effect for your account.

Payment is due at purchase or renewal. If a payment fails, your Service may be suspended until the balance is paid. You are responsible for all charges incurred through your account, including purchases made by anyone you allow to use it.

All sales are final. Devices, accessories, and SIM kits sold through our website are non-returnable and non-refundable once your order is placed, and shipping fees are non-refundable. Please check your plan and device selection before you check out.

Devices carry the warranty, if any, provided by their manufacturer. We make no additional warranty of our own beyond what the law requires.

You may transfer ("port") your existing phone number to 1776 Telecom, and you may port your number away from us at any time. Porting depends on your previous carrier releasing the number and may take several business days. We are not liable for delays caused by other carriers.

You agree not to use the Service for any unlawful purpose, including harassment, fraud, threats, or distribution of illegal content. You may not resell the Service, use it to operate a call center or telemarketing operation, use devices designed to interfere with networks, or use the Service in a way that degrades network performance for other customers. We may suspend or terminate Service for violations of this section.

We may suspend or terminate your Service, with notice where practicable, if you breach these Terms, fail to pay, or if we are required to do so by law enforcement, a court, or a regulator. You may cancel at any time; prepaid amounts for the current billing cycle are generally non-refundable except where required by law.

THE SERVICE AND DEVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE ARE NOT LIABLE FOR LOST PROFITS, LOST DATA, OR INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE PRECEDING THREE MONTHS. Some states do not allow these limitations, so they may not apply to you.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except for small claims court cases, any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by a recognized arbitration provider, not in court, and you and 1776 Telecom each waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by written notice to the address listed in Section 12.

We may update these Terms from time to time. The current version is always posted on this page with its effective date. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except where federal law or the law of your state of residence provides otherwise.
